Terms & Conditions
These Terms & Conditions (“Terms”) govern all services provided by Skyview Marketing
Solutions LLC (“Skyview,” “we,” “our,” or “us”). By booking services, accessing, downloading,
or using any media created by Skyview, the client (“Client”) acknowledges and agrees to be
bound by these Terms in full.
Skyview Marketing Solutions LLC provides marketing and visual media services only. Skyview
does not perform surveying, inspections, architectural verification, or legal review of properties.
Skyview does not guarantee or verify the accuracy of lot lines, boundary markings, square
footage, floor plan measurements, dimensions, zoning representations, or any structural or
physical characteristics of a property. Any floor plans, diagrams, or measurements provided are
for visual and marketing purposes only and may not reflect exact dimensions.
Any cosmetic or visual modifications made for marketing purposes, including but not limited to
virtual staging, virtual twilight, object removal, grass replacement, sky replacement, seasonal or
“winter-to-summer” transformations, and other digital enhancements, are representational in
nature and may not reflect the current or physical condition of the property.
The Client assumes full responsibility for the accuracy of all listing information, marketing
descriptions, MLS entries, and compliance with MLS rules, brokerage requirements, and
applicable laws. The Client is responsible for including appropriate disclaimers in MLS listings or
marketing materials when edited or enhanced media is used. Skyview assumes no liability for
claims, misunderstandings, or reliance arising from the use of edited or enhanced media.
By downloading or using Skyview media, the Client acknowledges and agrees to these terms.
All photos, videos, and related media created by Skyview remain the exclusive intellectual
property of Skyview Marketing Solutions LLC.
The Client is granted a limited, non-exclusive, non-transferable license to use the media solely
for marketing and advertising of the specific subject property for which the media was created.
This includes use on MLS platforms, real estate marketing websites, social media, and related
promotional channels directly associated with the listing.
Media may not be sold, transferred, sublicensed, reused for future listings, altered beyond basic
cropping or resizing, or provided to third parties without prior written consent from Skyview. This
license reflects the standard usage rights customarily granted within the real estate media
industry.
For standard services, payment is due at delivery and must be completed before the Client may
download or access media files. For larger or custom projects, a payment structure of fifty
percent (50%) due prior to production and fifty percent (50%) due upon project completion
applies unless otherwise agreed to in writing.
Skyview reserves the right to withhold delivery of media until payment is received in full. All
sales, retainers, booked time, and completed services are final. Skyview does not offer refunds
for completed work, partially completed projects, or services rendered.
Appointments canceled within forty-eight (48) hours of the scheduled time are subject to a one
hundred dollar ($100) reschedule fee. If Skyview arrives at the property and the property is not
shoot-ready, including but not limited to the presence of cleaners, contractors, excessive clutter,
ongoing work, lack of access, or other conditions preventing completion of services, a one
hundred dollar ($100) reschedule fee will apply.
No-show appointments are subject to a one hundred dollar ($100) cancellation fee. A no-show
is defined as thirty (30) minutes past the scheduled appointment time with no access provided
and no agent or authorized representative on site.
The Client is solely responsible for providing complete and accurate access instructions at the
time of booking and ensuring access is available at the scheduled time.
Skyview operates FAA Part 107–licensed drone pilots and maintains appropriate insurance
coverage. Drone services are subject to weather conditions, airspace restrictions, safety
considerations, and regulatory compliance.
If drone operations cannot be completed due to weather, airspace restrictions, or safety
concerns, the drone portion of the order will be removed or discounted accordingly.
Weather-related delays or limitations are handled on a case-by-case basis, and no penalty or
cancellation fee will be assessed in such circumstances.
Skyview reserves the right to delay, modify, or decline drone operations if conditions are
deemed unsafe or noncompliant.
Travel fees are built into Skyview’s booking and ordering system. Additional travel-related
charges may apply for locations outside standard service areas or requiring special
accommodations.
Standard delivery timelines, excluding Sundays and non-business days, are as follows: photos,
floor plans, and drone services are delivered within twenty-four (24) hours; virtual staging and
cosmetic edits within forty-eight (48) hours; and video services within seventy-two (72) hours.
Turnaround times are estimates and may be affected by factors outside Skyview’s control,
including weather conditions, access delays, client-requested revisions, or unforeseen technical
issues.
Skyview retains full creative discretion regarding compositions, angles, room selection, and the
number of images captured per space unless specific requests are communicated and
approved in advance. Skyview’s creative decisions are made in the interest of producing
effective marketing media.
Requests for additional coverage, angle changes, or revisions beyond the original scope of work
may require a return visit and will be billed accordingly.
The Client is responsible for ensuring the property is fully prepared at the scheduled shoot time.
This includes communicating with property owners, arriving in advance to prepare the space,
turning on lights, decluttering, removing vehicles from driveways, securing pets, and ensuring
general readiness.
Skyview may make minor adjustments at its discretion but is not responsible for staging,
cleaning, moving personal items, or managing property conditions. Properties are photographed
and filmed as-is. Skyview is not responsible for locking doors, turning off lights, fireplaces, or
property systems after the shoot.
Skyview maintains appropriate insurance coverage and operates in compliance with applicable
regulations. Skyview is not responsible for personal injury, property damage, loss of items, or
accidents occurring on site during or after services.
Skyview reserves the right to refuse, suspend, or terminate services if conditions are deemed
unsafe, inaccessible, or inappropriate, or if circumstances prevent safe and professional
completion of the work.
Skyview Marketing Solutions LLC reserves the right to use any media created for portfolio
display, marketing, advertising, website content, social media, and business development
purposes. The Client waives any claim to compensation, royalties, or approval rights related to
such promotional use.
By booking services with Skyview, the Client grants ongoing, perpetual, and irrevocable consent
for media usage as outlined in these Terms.
By placing an order, accessing, downloading, or using Skyview media, the Client agrees to all
Terms contained herein. Skyview is not responsible for marketing performance, property sale
outcomes, or third-party interpretations of the media.
